General Terms and Conditions of Sale (T&Cs)

Last updated: October 23, 2026

These general terms and conditions of sale apply to all sales made on the website www.purefoiegras.com by AMPLIAE, trading as Pure Foie Gras, a brand of Relais Gourmet (hereinafter “Pure Foie Gras”). Full details of the seller are given in the “Legal Information” section below.

Orders

Any order placed on the website implies full and complete acceptance of these terms of sale, which will be the only terms applicable to the contract concluded between the Customer and Pure Foie Gras.

Order Confirmation

The order will only be considered after the purchase has been confirmed on the website www.purefoiegras.com, meaning after the payment made by the Customer using one of the payment solutions offered on the website has been validated.
Pure Foie Gras reserves the right to refuse an order if the Customer fails to fulfil any of their obligations or, more generally, to refuse any order that appears abnormal for a legitimate reason (for example, suspected fraud).
The order becomes final only after confirmation by Pure Foie Gras. Pure Foie Gras will confirm the acceptance of the order to the Customer by email or letter, or, if necessary, its rejection, within 48 business hours after the order is placed on the website.

Right of Withdrawal

Withdrawal period. In accordance with Articles L.221-18 et seq. of the French Consumer Code, if you are a consumer, you have the right to withdraw from your contract within fourteen (14) days without giving any reason and without incurring any costs other than those described below (Articles L.221-23 and L.221-24 of the French Consumer Code). The withdrawal period expires 14 days after the day on which you, or a third party other than the carrier and indicated by you, take physical possession of the goods. If your order includes several items delivered separately, the period expires 14 days after the day on which you take physical possession of the last item. For eBooks and other digital content not supplied on a tangible medium, the period expires 14 days after the day on which the contract is concluded. If the period expires on a Saturday, Sunday or public holiday, it is extended until the next working day.

Exceptions. In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal does not apply to:

  • goods which have been unsealed by you after delivery and which cannot be returned for reasons of hygiene or health protection, such as tins, jars or bottles of food or drink that have been opened or whose seal has been broken (Article L.221-28, 5°);
  • digital content not supplied on a tangible medium (such as our eBooks), once the download has begun with your prior express consent and your acknowledgement that you thereby lose your right of withdrawal (Article L.221-28, 13°).

Our preserved products (whole foie gras, gourmet appetizers and gourmet hampers) keep for at least 2 years at room temperature: they can therefore be returned under the right of withdrawal as long as they are unopened and their seal is intact.

How to withdraw. To exercise your right of withdrawal, you must inform us of your decision to withdraw from the contract by an unequivocal statement sent before the withdrawal period expires. You may:

  • use our online withdrawal function: Withdraw from contract here;
  • send us an email at info@purefoiegras.com;
  • send us a letter by post to: Pure Foie Gras – Returns Department, 14 rue Burugoria, 64700 Hendaye, France;
  • or use the model withdrawal form below, although this is not obligatory.

If you use our online withdrawal function, we will send you an acknowledgement of receipt of your withdrawal on a durable medium (by email) without delay.

Returning the goods. You must send back the goods to Pure Foie Gras – Returns Department, 14 rue Burugoria, 64700 Hendaye, France, without undue delay and in any event not later than 14 days from the day on which you communicated your withdrawal to us. The direct cost of returning the goods will be borne by you. You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish their nature, characteristics and proper functioning (Article L.221-23 of the French Consumer Code).

Refund. If you withdraw from the contract, we will reimburse all payments received from you, including the costs of delivery (with the exception of any supplementary costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed of your decision to withdraw (Article L.221-24 of the French Consumer Code). We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent them back, whichever is the earliest. We will carry out the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement.

If the recipient is absent at the time of delivery, Pure Foie Gras cannot be held responsible for any damage to the products or for the failure to collect the parcel.

“Satisfaction or Refund” Guarantee

Our customers agree to strictly adhere to the storage conditions of the products, as well as the expiration date indicated on the packaging. We recommend that the recipient check the quantity and condition of the products upon receipt and inform us in writing as soon as possible (ideally within 48 hours of delivery, with photos if possible) of any missing or damaged item, so that we can open a claim with the carrier. This recommendation does not affect your right of withdrawal or your legal guarantees described in these terms.

In addition to, and without prejudice to, your right of withdrawal and your legal guarantees, we offer a commercial “Satisfaction or Refund” guarantee: we accept the return of all new items returned within 15 days of delivery. Any returned product must be in its original packaging and accompanied by the proof of purchase. We do not accept returns of items that are not in their original condition, i.e., products of which more than 15% of the initial weight has been consumed.

Returns of products for exchange or refund are made by mail to the following address: Pure Foie Gras – Returns Department, 14 rue Burugoria, 64700 Hendaye, France. Please carefully pack the returned items and send them with the invoice and a letter specifying whether you would like an exchange or a refund. Refunds are made using the same means of payment as the one used for the order, unless you expressly agree to another means (for example, a gift voucher).

Legal Guarantees

Goods: legal guarantee of conformity and legal guarantee against hidden defects

The consumer has a period of two years from delivery of the goods to obtain the implementation of the legal guarantee of conformity in the event of a lack of conformity. During this period, the consumer only needs to establish the existence of the lack of conformity and not the date on which it appeared.

Where the contract for the sale of the goods provides for the supply of digital content or a digital service on a continuous basis for a period of more than two years, the legal guarantee applies to that digital content or digital service throughout the planned supply period. During this period, the consumer only needs to establish the existence of the lack of conformity affecting the digital content or digital service and not the date on which it appeared.

The legal guarantee of conformity entails an obligation for the trader, where applicable, to provide all updates necessary to maintain the conformity of the goods.

The legal guarantee of conformity entitles the consumer to the repair or replacement of the goods within thirty days of their request, free of charge and without major inconvenience to them.

If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee.

If the consumer requests the repair of the goods but the seller imposes their replacement, the legal guarantee of conformity is renewed for a period of two years from the date of replacement of the goods.

The consumer may obtain a reduction in the purchase price while keeping the goods, or terminate the contract and obtain a full refund against return of the goods, if:
1° The trader refuses to repair or replace the goods;
2° The repair or replacement of the goods takes place after a period of thirty days;
3° The repair or replacement of the goods causes major inconvenience to the consumer, in particular where the consumer definitively bears the costs of taking back or removing the non-conforming goods, or bears the costs of installing the repaired or replacement goods;
4° The lack of conformity of the goods persists despite the seller’s unsuccessful attempt to bring them into conformity.

The consumer is also entitled to a reduction in the price of the goods or to the termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination of the contract. In that case, the consumer is not required to first request the repair or replacement of the goods.

The consumer is not entitled to termination of the sale if the lack of conformity is minor.

Any period during which the goods are immobilised for repair or replacement suspends the remaining guarantee period until the reconditioned goods are delivered.

The rights mentioned above result from the application of Articles L.217-1 to L.217-32 of the French Consumer Code.

A seller who, in bad faith, obstructs the implementation of the legal guarantee of conformity incurs a civil fine of up to 300,000 euros, which may be increased to 10% of average annual turnover (Article L.241-5 of the French Consumer Code).

The consumer also benefits from the legal guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code, for a period of two years from the discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or to a full refund against return of the goods.

Digital content (eBooks): legal guarantee of conformity and legal guarantee against hidden defects

The consumer has a period of two years from the supply of the digital content or digital service to obtain the implementation of the legal guarantee of conformity in the event of a lack of conformity. During a period of one year from the date of supply, the consumer only needs to establish the existence of the lack of conformity and not the date on which it appeared.

The legal guarantee of conformity entails an obligation to provide all updates necessary to maintain the conformity of the digital content or digital service.

The legal guarantee of conformity entitles the consumer to have the digital content or digital service brought into conformity without undue delay following their request, free of charge and without major inconvenience to them.

The consumer may obtain a reduction in the price while keeping the digital content or digital service, or terminate the contract and obtain a full refund in exchange for giving up the digital content or digital service, if:
1° The trader refuses to bring the digital content or digital service into conformity;
2° Bringing the digital content or digital service into conformity is unjustifiably delayed;
3° The digital content or digital service cannot be brought into conformity without costs being imposed on the consumer;
4° Bringing the digital content or digital service into conformity causes major inconvenience to the consumer;
5° The lack of conformity of the digital content or digital service persists despite the trader’s unsuccessful attempt to bring it into conformity.

The consumer is also entitled to a reduction in the price or to the termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination of the contract. In that case, the consumer is not required to first request that the digital content or digital service be brought into conformity.

Where the lack of conformity is minor, the consumer is entitled to terminate the contract only if the contract does not provide for the payment of a price.

Any period during which the digital content or digital service is unavailable for the purpose of being brought back into conformity suspends the remaining guarantee period until the digital content or digital service is supplied in conformity again.

The rights mentioned above result from the application of Articles L.224-25-1 to L.224-25-31 of the French Consumer Code.

A trader who, in bad faith, obstructs the implementation of the legal guarantee of conformity incurs a civil fine of up to 300,000 euros, which may be increased to 10% of average annual turnover (Article L.242-18-1 of the French Consumer Code).

The consumer also benefits from the legal guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code, for a period of two years from the discovery of the defect. This guarantee entitles the consumer to a price reduction if the digital content or digital service is kept, or to a full refund in exchange for giving up the digital content or digital service.

In the event of a dispute, and after the attempt at an amicable settlement described above, the consumer may bring proceedings, at their choice, before any of the courts with territorial jurisdiction under the French Code of Civil Procedure or before the court of the place where they lived at the time the contract was concluded or the harmful event occurred (Article R.631-3 of the French Consumer Code). Consumers domiciled in another Member State of the European Union may also bring proceedings before the courts of their place of domicile.
